DISPUTE RESOLUTION

EFFECTIVE DATE: January 1, 2025

1. INFORMAL RESOLUTION

1.1 Before initiating formal proceedings, both parties agree to attempt to resolve disputes informally.

1.2 Users must submit a written notice of dispute to the Platform Owner's support channel, describing the nature of the dispute and desired outcome.

1.3 The Platform Owner will respond within 30 days. Both parties will make good-faith efforts to resolve the dispute within 60 days of the initial notice.

2. BINDING ARBITRATION

2.1 If informal resolution fails, disputes shall be resolved through binding arbitration, except as provided in Section 4.

2.2 Arbitration shall be conducted by a mutually agreed arbitration body, or in the absence of agreement, by a recognized commercial arbitration institution with jurisdiction.

2.3 Arbitration shall be conducted in English unless otherwise agreed.

2.4 The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

3. JURISDICTION FLEXIBILITY

3.1 This platform operates across multiple jurisdictions. The governing law and arbitration venue shall be determined as follows:

  • For users in Nigeria: Nigerian Arbitration and Conciliation Act, Lagos as venue
  • For users in the UK/EU: English law, London as venue
  • For users in other jurisdictions: laws of the Platform Owner's primary jurisdiction, with venue determined by the Platform Owner

3.2 Notwithstanding the above, the Platform Owner may pursue injunctive or other equitable relief in any court of competent jurisdiction.

4. EXCLUDED MATTERS

The following matters are not subject to arbitration and may be pursued directly in court:

  • Injunctive relief for intellectual property infringement or misappropriation
  • Enforcement of arbitral awards
  • Small claims court matters within applicable monetary thresholds

5. CLASS ACTION WAIVER

TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS. USERS WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

6. TIME LIMITATION

Any claim must be brought within one (1) year of the event giving rise to the claim, or it is permanently barred.

7. COSTS

Each party bears its own costs in arbitration unless the arbitrator determines that a party has acted in bad faith, in which case costs may be awarded against the offending party.
